Supreme Court Upholds Part of Arizona Immigration Law

Today, the Supreme Court, in a 5-3 vote, uphold portions of Arizona’s anti-immigration policy requiring employers to use eVerify to check on the immigration status of prospective employees prior to hiring them, and revoking business licenses of employers who knowingly hire undocumented labor.

The argument behind the policy is the same on both sides and essentially boils down to separation of powers. Is the state action infringing on territory reserved to the exclusive control of the Federal Government. The Court’s ruling today says no- and this could be a sign of more anti-immigration legislation to come, as states try to reciprocate Arizona’s actions knowing they now have the backing of the Nation’s highest Court.
