Robbery is a serious felony in Arizona. It is a theft at its core, but it involves an added step of threatening the use of force on a person or using force against the person. Robbery is a class four felony. A first time offender is looking at up to three years in prison with a presumptive sentence of 2.5 years. A.R.S. 13-1902 sets forth the law on Robbery.

A person commits robbery if in the course of taking any property of another from his person or immediate presence and against his will, such person threatens or uses force against any person with intent either to coerce surrender of property or to prevent resistance to such person taking or retaining property.

Robbery has a few elements that the prosecutors must prove against you, and the Alcock & Associates attorneys are very experienced in handling Robbery cases. The State must prove the following five elements:

  1. Taking the property
  2. Property is someone else’s
  3. Against the victim’s will
  4. Either
    • Threat of force; OR
    • Use of force
  5. Either
    • Intent to force the victim to give you property; OR
    • Intent to prevent resistance to taking or keeping property

Any one of these elements can be lacking from the State’s case, and the attorneys at Alcock can help you see whether the State has a chance at meeting its burden at trial. A robbery can be incomplete simply by lacking evidence that the property belonged to someone else, for instance.

The Maricopa County Prosecutor looks very seriously at Robberies and will normally give a plea offer for prison time or jail time. This can be aggravated by being with an accomplice, having a prior record, causing injuries to the victim, and using a dangerous weapon. An aggravated Class Four Felony can carry 3 years and 9 months for a first time offender. Penalties are harsher for offenders with priors. If a deadly weapon is used, your Robbery can be charged as Dangerous, leading to classification in a harsher sentencing category.
