How Your Arizona DUI Sentence Can Be Even Tougher Than You Thought

The majority of individuals who reside in Arizona are well aware that we have some of the strictest penalties for DUI offenders in the entire nation. But did you know that Arizona DUI laws carry even harsher punishments for drivers who endanger others beyond just drinking and driving?

It goes without saying that if you’re convicted for a DUI you can expect some serious punishment. However, if you meet the criteria for a sentencing enhancement, it can be even worse. Such sentencing enhancements are deliberately intended to punish drivers for endangering others. So if the judge decides that your particular DUI is especially dangerous, you can expect a much harsher sentence. Additional punishments can (and most likely will) include a longer incarceration, higher fines, or both. It could also mean additional charges or literally the difference between a misdemeanor and a felony.

No one is likely to dispute that drunken driving is always dangerous, but if someone actually gets hurt you can count on a more serious sentence. Suddenly, your charge escalates to what is known as an aggregated DUI which is a felony that carries serious penalties.

If you have a child under the age of 15 in your car when you’re busting for driving while intoxicated, the charge is automatically elevated to a felony. That means a mandatory license revocation and up to two years in prison if convicted.

For adults 21 and over in Arizona, the legal blood-alcohol limit is 0.08% and zero if you’re under 21. But a BAC of 0.16% or more is considered “extreme,” and over 0.20% is “super extreme” which will also lead to a much harsher sentence.

Another good example is when a driver violates Arizona’s implied consent laws. As a condition of getting an Arizona driver’s license, you agree to submit to a Breathalyzer or blood test if you’re ever stopped for a suspected DUI. Should you refuse either of these tests, your license is automatically suspended for one year (even if your case is later dismissed).
