A person commits robbery in Arizona if in the course of taking any property of another from his person or immediate presence and against his will, such person threatens or uses force against any person with intent either to coerce surrender of property or to prevent resistance to such person taking or retaining property. In Arizona, the crime of robbery is generally charged as a class 4 felony.

However, robbery can carry even more severe consequences. For example, if one or more accomplices are present in the course of the robbery the statute allows defendants to be charged with aggravated robbery, a class 3 felony. If a weapon was involved, the crime can be classified as an armed robbery. Armed robbery is a class 2 felony in Arizona. Although guns are the most commonly used weapon knives and other objects that cause bodily harm to a victim can lead to the same charge.

A surprisingly large number of robberies are committed without the use of an actual weapon, but rather with the use of strong-arm techniques. This is known as strong-armed robbery where typically one or more individuals or two or more surround the victim, often in a dark, lonely place and threaten to use force unless he hands over all his valuables. A mugging is a good example of a strong-armed robbery. As stated before, the most important factors to consider are whether or not a weapon was used, and whether or not the victim suffered any injury.

Yet another common case is what’s known as a home invasion robbery. This is a situation where the robber enters a home by force and forces the homeowner into submission. In this type of offense, kidnapping is also typically charged. In Maricopa County, prosecutors tend to treat home invasion cases very seriously. The State typically seeks lengthy prison sentences for these cases.
