US to Offer TPS for Syrian Nationals

Immigration attorneys have good news for Syrian clients either in deportation or removal proceedings with fear of returning to their homeland given the current climate in Syria at the time being- they don’t have to. At least for now.

In a statement by Department of Homeland Security (DHS) Secretary Janet Napolitano earlier this week, the decision to extend temporary protected status, or TPS, to Syrian nationals was confirmed. TPS is a protected status that can be offered to foreign nationals already present in the United States for, you guessed it, a temporary period of time based on deteriorating, unstable, or dangerous conditions in their country of origin. The right to legal work authorization would attach to a grant or extension of TPS, but TPS itself would only be given to Syrian nationals already present in the United States.

“In light of the deteriorating conditions in Syria, I am announcing that DHS will be designating Syria for Temporary Protected Status (TPS) for Syrians currently present in the United States. Conditions in Syria have worsened to the point where Syrian nationals already in the United States would face serious threats to their personal safety if they were to return to their home country. ” – Secretary of Department of Homeland Security Janet Napolitano on TPS for Syrian Nationals in United States.

This announcement is welcome news for Syrian ex-pats currently in the country on a VISA that may have been set to expire, and Arab-American nationals in general approve of the decision. Phoenix immigration lawyer Darius Amiri lauds the DHS decision as well. “Considering the climate of anti-Westernism in that region, coupled with the atrocities being committed by the Syrian government upon its own people, it would be dangerous or even deadly to send a Syrian national back there after an extended period of time in the United States.”
